"Confirmatory Bias,"
is the culprit in illogical thinking. It means "we
accept (and
greedily
hunt
for) data that validates our beliefs, and dismiss even rational
evidence that undermines it"
according to new brain research.
This recent ARTICLE in Scientific American explains what happens to our brains when confronted with information that does not conform to our beliefs, no matter how credible the data. People perceive the court as a place of facts, logic, rational thinking and how to frame an argument. It is also a place where human bias is rampant. If you cannot "see" the facts because you run with your emotions, you may be human, but you are not fit to decide upon people's lives. This article explains why people vote against issues that benefit them. Apply this to the legal field - and you see why we have so many judges, therapists and lawyers doing such irrational things as giving children to abusers and punishing mothers for trying to protect them. and in Children's Legal Rights Journal, Vol. 26, No. 1, 2006 : "The article concludes that science, law, and policy all support PAS's present and future inadmissibility."
